My recollection of our conversation was that I would submit a Il:tter to you <br />outlining my interpretation of the language in the Owl Canyon and Rex reclamation <br />plans. Simultaneously, you indicated a desire to obtain the additional information <br />from Colorado Lien as requested in your March 3 letter. I have passed your request <br />on to Sam Lien and asked that she or someone at Colorado Lien call you if their <br />response on those issues cannot be given before March 31, 1998. <br />Regarding the interpretation issues, please consider this letter as setting forth <br />the legal interpretation of the two reclamation plans. Because both reclamation <br />plans are so similar, please consider these comments as being applicable to both <br />reclamation plans. Please consider the following. <br />The reclamation plans were submitted in 1977 and then amended in 1985. In <br />your March 3 letter, if I understand it correctly, you set forth the Department's <br />interpretation of the reclamation requirements of Lien as required by the 11377 plan(s) <br />and the 1985 amendment(s) to the plan(s). I interpret the Department's position to <br />be that the language of the plans require final grading generally to a slope of 4:1 to <br />5:1 which, under your interpretation is "compatible with similar terrain in thE~ vicinity." <br />
