Long <br />Division Director <br />Construction Materials Amendment, AM-02 <br />Dear Mr. Davis: <br />I am in receipt of a letter from your consultant Southwest Ecological Consultants, Mark Heffner, requesting <br />a change in the date of filing of the application. Apparently he did not receive our letter establishing the <br />permit completeness date. This is not a problem, according to paragraph 1.4.1(13) of the rules below, the <br />Office can add the number of days to the decision date that the publication was delayed compared to the <br />required ] 0 days. <br />1.4.1 (13) Failure of an Applicant to publish the notice pursuant to Paragraph 1.6.2(1)(d) shall add a <br />sufficient number of days for the required public notice to be accomplished. An additional time period, as <br />determined by the Office, may be added for the Office or Board to make a decision. Such time period shall <br />not exceed thirty (30) days for any 110 or 110(6) Limited Impact application, ninety (90) days for any 112 <br />Reclamation Permit application without objections, or 120 days for any 112 Reclamation Permit <br />application with objections. <br />As the publication was 4 days later than the required publication date of April 29, 2002, (published May 2, <br />2002) the decision date is therefore extended 4 davs, to July 22, 2002.
