I told Mr. Dan
Beley of that department that this division is requesting Trapper
to make topsoil stockpile D-77-1 a small area exemption, due to the
fact that the runoff from this area, technically, leaves the permit
area without being treated by a sedimentation pond. I explained to
Mr. Beley that the runoff then crosses back onto the permit area
and reports to a sediment pond that is under the NPDES permit.
Dan Beley informed me that, under these circumstances, no
stormwater permit would be required. According to Mr. Beley, the
stormwater permit requirements do not consider permit boundaries,
only whether the runoff enters state waters. And because the runoff
does go to an NPDES site, the stormwater permit would be an
unwanted duplication of efforts. Mr. Beley also stated that Trapper
would not have to notify The Department of Public Health and
Environment of this small area exemption.
If you have any questions, please call me.
Sincerely,
~~
os ph ~ Dudash
nvironmental Protection Specialist
C:\WP51\TRAPPER\MR147SAE
