BOX 1$7 Divisiun Dbecmr <br />Craig, Colorado 81626 <br />RE: Minor Revision No. 147, Topsoil Haulage, Trapper Mine, Permit <br />No. C-81-010, Trapper Mining Inc. <br />Dear Mr. Luke: <br />This letter is to document a telephone conversation that the <br />Division had with the Colorado Department of Public Health and <br />Environment, concerning Minor Revision No. 147. I told Mr. Dan <br />Beley of that department that this division is requesting Trapper <br />to make topsoil stockpile D-77-1 a small area exemption, due to the <br />fact that the runoff from this area, technically, leaves the permit <br />area without being treated by a sedimentation pond. I explained to <br />Mr. Beley that the runoff then crosses back onto the permit area <br />and reports to a sediment pond that is under the NPDES permit. <br />Dan Beley informed me that, under these circumstances, no <br />stormwater permit would be required. According to Mr. Beley, the <br />stormwater permit requirements do not consider permit boundaries, <br />only whether the runoff enters state waters. And because the runoff <br />does go to an NPDES site, the stormwater permit would be an <br />unwanted duplication of efforts.
