Walther <br />3131 BaCie[[ Rd. 4ecuave Duectoi <br />Colorado Springs, CO 80926 Michael B tong <br /> Division Director <br />RE: Red Canyon Quarry, Amendment A pproval, Permit No. M•1985-043 <br />Revision No. AM-2 <br />Dear Mr. Stack: <br />On July 20, 2001 [he Mined Land Reclamation Boazd conditionally approved the Amendment application <br />submitted to the Division on January 29, 2001, addressing the following: <br />Expanding the affected lands from 40 to 110 acres and reversing the direction of mining. <br />The terms of the Amendment No. 2 approved by [he Board are hereby incorporated into Permit No. M-1985-043. <br />The conditions of the Board approval are noted below. Please note that all other provisions of Permit No. <br />M-1985-043 remain in full force and effect. <br />Stiptlation No. <br />Description <br />Stipulation 1. The applicant is not allowed to conduct a mining operation (or cause lands to be <br />disturbed, as defined in Rulel.l(3) within the permitted area unless the operation is in <br />compliance with state and federal Endangered Species Act (ESA) requirements as <br />de[etmined by the Colorado Division of Wildlife and the U.S. Fish and Wildlife Service, <br />if applicable. The applicant must submit evidence to the Division that the mining <br />operation is in compliance with the ESA prior to disturbing any acreage within the permit <br />azea that implicates ESA requtrements. <br />Clarification of Stipulation Number I <br />The applicant is allowed to mine all areas of the permit where the Endangered Species <br />Act does not apply, currently outlined as a take avoidance area (TAA), and areas where <br />the ESA does apply if the applicant is in compliance with ESA requirements. The U.S. <br />Fish and Wildlife Service (USFS) delineated acreage within the permit boundaries (the <br />TAA) where they have determined that threatened species (Mexican Spotted Owls) will <br />not be adversely affected by the mining operation.
