Dear Mr. Stack:
On July 20, 2001 [he Mined Land Reclamation Boazd conditionally approved the Amendment application
submitted to the Division on January 29, 2001, addressing the following:
Expanding the affected lands from 40 to 110 acres and reversing the direction of mining.
The terms of the Amendment No. 2 approved by [he Board are hereby incorporated into Permit No. M-1985-043.
The conditions of the Board approval are noted below. Please note that all other provisions of Permit No.
M-1985-043 remain in full force and effect.

Description
Stipulation 1. The applicant is not allowed to conduct a mining operation (or cause lands to be
disturbed, as defined in Rulel.l(3) within the permitted area unless the operation is in
compliance with state and federal Endangered Species Act (ESA) requirements as
de[etmined by the Colorado Division of Wildlife and the U.S. Fish and Wildlife Service,
if applicable. The applicant must submit evidence to the Division that the mining
operation is in compliance with the ESA prior to disturbing any acreage within the permit
azea that implicates ESA requtrements.
Clarification of Stipulation Number I
The applicant is allowed to mine all areas of the permit where the Endangered Species
Act does not apply, currently outlined as a take avoidance area (TAA), and areas where
the ESA does apply if the applicant is in compliance with ESA requirements. The U.S.
Fish and Wildlife Service (USFS) delineated acreage within the permit boundaries (the
TAA) where they have determined that threatened species (Mexican Spotted Owls) will
not be adversely affected by the mining operation. The current TAA boundaries can be
reduced or expanded in [he future if Mexican Spotted Owl monitoring activities indicate
it is necessary to increase or decrease the TAA [o protect the birds.
