Box 683 -193 Placer DrivelFairplay ,Colorado 80440 - ~ ` " `- <br />719-836-3102 <br />Park county Commisssioners MAR j2 <br />Fairplay, CO 80940 (by certified letter) <br />Mined L <br />Dear Commissioners, Rgrlamafi0n <br />I understand that the terms and conditions of the MLRD Permit <br />for M&M Mining-Snowstorm Pit are being reviewed by the MLRB. <br />Of ongoing concern, is the long term impact on residential <br />propert~• values and future land use by unreclaimed mining <br />activity in Park County. Two main problems currently exist: <br />Mine closure can be postponed almost indefinitely thereby <br />postponing reclamation requirements; and bonds required by <br />the MLRD have been grossly inadequate for reclamation <br />even when forfeited. The director of the MLRD cited seven <br />such forfeitures in Park County, It has simply been cheaper <br />for mining operations to forfeit bonds than to attempt even <br />minimal reclamation efforts. <br />Of specific concern is insurin~~ reclamation efforts by M&M <br />--or future ownerships since bonds and permits may be trans- <br />ferred. M&M has an expansive operation, it is surrounded by <br />permanent residential subdivisions, and historic and massive <br />new disturbances already exist going unreclaimed. These <br />conditions mandate reclamation efforts not be postponed for <br />the proposed 100 year permit, nor that insufficient funds <br />exist if a given owner eventually forfeits bond. <br />Etta Everett informed me by letter 9/5/90 that Mary Jane Valdez <br />Park County enforcement officer, had spoken with Gregg Squire <br />of the MLRD and said that "it is conceivable that M&M could <br />operate until 2090 without reclamation, but the bond would be <br />prohibitive." <br />I ask you as Commissioners to intervene on behalf of the <br />residents of surrounding area to ensure that 1) bonding is <br />adequate and reasonable for insuring reclamation in a timely <br />manner and 2) that the regular inspection be conducted to <br />verify that reclamation is in process before allowing a new 6 <br />acre tract to be disturbed--per M&M's proposal May 18, 1990. <br />Please inform me of your actions taken. <br />Thank You, <br />Steven R.
