Long <br />Division Dmeaor <br />Conditional Approval, Varra Companies/Frontier <br />Site, Technical Revision TR-002, Permit No. <br />Per your request, this letter is intended to clarify Stipulation No. 02 <br />to the May 10, 1995 approval of the above referenced technical revision. <br />The first sentence of Stipulation No. 02, <br />ALL EXISTING TOPSOIL (A-HORIZON) MATERIAL SHALL BE SALVAGED ON ANY <br />NEWLY DISTURBED AREAS AND STOCKPILED AND USED ON SITE FOR <br />RECLAMATION <br />is intended to assure that the most valuable component of the soil profile <br />will remain uncontaminated for use in reclamation. This part of the <br />stipulation can obviously only apply to newly disturbed areas. The second <br />sentence of Stipulation No. 02, <br />THE COMBINATION OF REPLACED TOPSOIL AND NON-CLAY OVERBUF2DEN WILL NOT <br />BE LESS THAN 10 INCHES IN THICKNESS OVER THE RECLAIMED AREAS <br />is intended to assure provision of an adequate rooting zone and capillary <br />barrier over areas of heavy clay that are currently exposed at the site, <br />and that may be exposed by future mining activity at the site, The second <br />sentence of Stipulation No. 02 applies to both the e>,:isting site <br />disturbances and to any newly disturbed areas in the future. <br />A specific point of clarification applies to the following sentence in <br />your May 26, 1995 letter: <br />Our interpretation of your statement made to the Board is that the <br />Technical Revision requires that no less than 10 inches of topsoil <br />and overburden must be spread over the disturbed areas. <br />
