<br />NOTICE OF PROPOSED DECISION <br />The Colorado Mined Land Reclamation Division has approved with conditions an <br />application for a revision (PR-02) to the existing permit to conduct coal <br />mining and reclamation operations submitted by the Western Fuels-Utah fur the <br />Deserado Mine. The revision will allow the addition of a Federal Bypass Coal <br />Lease area (No. C-44693) to the approved mine plan. <br />The Deserado Mine operation is located in Rio Blanco County, approximately 9 <br />miles from Rangely, Colorado. The mine is an underground operation with an <br />anticipated maximum production capacity of 1,3 million tons per year. The <br />coal to be mined is federally owned, anA the surface to be affected is <br />federally and privately owned. The revised portion of the permit area <br />encompasses approximately 344.3 acres in section 7, T2N, R101 and Section 36, <br />T3N, R101W. <br />This proposed approval decision is based on a finding that the proposed <br />operation will comply with all requirements of the Colorado Surface Coal <br />Mining Reclamation Act, f..R.S. 34-33-101, et sea., and the regulations <br />promulgated thereunder. <br />Copies of the proposed decision including stipulations, are on file for public <br />inspection at the Colorado Mined Land Reclamation Division, Room 423, <br />Centennial Building, 1373 Sherman Street, Denver, Colorado 80203 and at the <br />County Clerk's Office in Rio Blanco County, p. 0. Box 599, Meeker, CO. <br />persons with an interest that may be adversely affected by the proposed <br />decision may request a formal hearing before the Mined Land Reclamation Board <br />on the proposed decision. Such request must be made within thirty (30) days <br />of the initial publication of this notice, must be in writing, and must state <br />with reasonable specificity the reasons for the request and the objections to <br />the proposed decision. <br />3367E <br />
