Walker <br />Environmental Protection Specialist <br />Division of Reclamation, Mining & Safety <br />Department of Natural Resources <br />1313 Sherman Street, Rm. 215 <br />Denver, Colorado 80203 <br />Re: Foidel Creek Mine (Permit No. C-1982-056) <br />Technical Revision Application No. 59 (TR-59) <br />Addition of Wash Plant and Associated Work (CHS #49780) <br />Dear Mr. Walker: <br />Thank you for your correspondence dated March 6, 2007 (received by our office on March 9) <br />concerning the technical revision to the permit listed above. <br />It is our opinion that the proposed technical revision will have no effect on cultural resources since the <br />construction of the proposed coal wash plant and associated activities will take place on previously <br />disturbed lands in the facilities area of the current permit and will not otherwise alter previously <br />approved permit conditions. <br />If archaeological resources are discovered during project activities, work must be interrupted until the <br />resources have been evaluated in terms of the National Register of Historic Places eligibility criteria (36 <br />CFR 60.4) in consultation with our office. <br />Thank you for the opportunity to comment.
