Lonq, Director <br />Approval <br />Grand Valley Coal Company <br />Munger Canyon Mine (Permit C-81-020) <br />Transfer of Permit Rights <br />The Colorado Division of Minerals and Geology; Office of Mined Land <br />Reclamation proposes to conditionally approve an application for <br />transfer of permit rights for the Munger Canyon Mine (Permit <br />C-81-020) to Grand Valley Coal Company. Permit transfer is granted <br />pursuant to the Colorado Surface Coal Mining Act 34-33-101 et. sea. <br />C.R.S. 1973 as amended and Regulation 2.08.6 of the Regulations of <br />the Colorado Mined Land Reclamation Board for Coal Mining. <br />Previous permittee and operator was Salt Creek Mining Company. <br />This approval is conditional upon satisfactory resolution of five <br />audit appeals filed by Grand Valley Coal Company's parent company, <br />Adobe Mining, with the Office of Surface Mining. Due to the <br />conditional nature of this approval the Division shall maintain <br />Salt Creek Mining Company's performance bond until such a time that <br />Grand Valley Coal Company receives unconditional approval for <br />transfer of permit rights. Submittal of evidence of satisfactory <br />resolution of the aforementioned appeals must be received from the <br />Office of Surface Mining prior to the Division issuance of <br />unconditional approval as per Rule 2.07.6(1)(b)(ii) and (iii) <br />The conditional approval decision for transfer of permit rights is <br />based on findings that Grand Valley Coal Company will conduct <br />operations if full compliance with the terms and conditions of the <br />original permit and will comply with all requirements of the Act <br />and the Regulations promulgated pursuant to the Act. <br />A 3o day comment period shall be initiated during which any person <br />with an interest which is or may be adversely affected may request <br />a formal hearing on the decision. Such request shall be in writing <br />and state with reasonable specificity the reasons for the request <br />and objections to the decision. If so requested, the formal <br />hearing shall be conducted in accordance with the requirements of <br />2.07.4(3). <br />
