Colorado Division of Minerals and Geology
Office of Mined Land Reclamation
Michael B. Lonq, Director
Approval
Grand Valley Coal Company
Munger Canyon Mine (Permit C-81-020)
Transfer of Permit Rights
The Colorado Division of Minerals and Geology; Office of Mined Land
Reclamation proposes to conditionally approve an application for
transfer of permit rights for the Munger Canyon Mine (Permit
C-81-020) to Grand Valley Coal Company. Permit transfer is granted
pursuant to the Colorado Surface Coal Mining Act 34-33-101 et. sea.
C.R.S. 1973 as amended and Regulation 2.08.6 of the Regulations of
the Colorado Mined Land Reclamation Board for Coal Mining.
Previous permittee and operator was Salt Creek Mining Company.
This approval is conditional upon satisfactory resolution of five
audit appeals filed by Grand Valley Coal Company's parent company,
Adobe Mining, with the Office of Surface Mining. Due to the
conditional nature of this approval the Division shall maintain
Salt Creek Mining Company's performance bond until such a time that
Grand Valley Coal Company receives unconditional approval for
transfer of permit rights. Submittal of evidence of satisfactory
resolution of the aforementioned appeals must be received from the
Office of Surface Mining prior to the Division issuance of
unconditional approval as per Rule 2.07.6(1)(b)(ii) and (iii)
The conditional approval decision for transfer of permit rights is
based on findings that Grand Valley Coal Company will conduct
operations if full compliance with the terms and conditions of the
original permit and will comply with all requirements of the Act
and the Regulations promulgated pursuant to the Act.
A 3o day comment period shall be initiated during which any person
with an interest which is or may be adversely affected may request
a formal hearing on the decision. Such request shall be in writing
and state with reasonable specificity the reasons for the request
and objections to the decision. If so requested, the formal
hearing shall be conducted in accordance with the requirements of
2.07.4(3).
