This is done in accordance with Rule: 1.7.4(2) of
the Mineral Rules and Regulations. The informal conference will be held
at Division offices, Room 215, 1313 Sherman Street, Denver, at 1:30 p.m.
on October 13, 1995. At the informal conference, the City of Boulder
should be prepared to set forth the grounds for their objections to the
application. The hearing before the Board is scheduled for the November
15-16, 1995 Board meeting, and will be held beginning at 9:00 each day,
or as soon thereafter as the matter can be heard, in Room 318, Centennial
Building, 1313 Sherman Street, Denver.
The date established for Division consideration of the amendment
application was October 4, 1995. As of that date, the Division has issued
a recommendation that the Mined Land Reclamation Board approve the
amendment application at the November Board hearing. The grounds for the
Division's recommendation to approve the amendment are as follows:
The City of Boulder's letter of objection to the amendment
application makes reference to previous letters of objection related
to Jenkins Site technical revision TR-002. The previous letters of
objection are dated April 21, 1995 and July 21, 1995. Phe Division
has provided detailed responses to the City of Boulder's objections
in a letter to Mr. Joseph de Raismes dated May 3, 1995. In that
letter, the Division stated that virtually all of the City's
objections are unfounded when reviewed in terms of thfa Mined Land
Reclamation Act.
2
