eaceptions, had been completed in accordance with the approved <br />reclamation plan permit, and that $80,000 was sufficient <br />bonding for the reclamation work remaining. <br />The Allens, through their attorneys, filed their request <br />for an adjudicatory hearing before the Board on April 20, <br />1987. That request incorporated their objections filed on <br />March 11, 1987, as the basis for their objections to the <br />partial release. The Allens' objections do not contend that <br />Blue Ribbon's reclamation fails to comply with the permit. <br />Rather, the Allens contend that the approved postmining land <br />use should be revised from wildlife habitat and grazing to <br />include industrial. They also contend that the approved <br />reclamation plan should be revised to allow retention of the <br />access road to the portal and to allow the portal to remain <br />open to the degree that allows safe and reasonable access to <br />the underground workings.l <br />The basis for the Allens' position is that the 1975 <br />Purchase Agreement requires the return of the mine site to them <br />by Blue Ribbon in this condition.
