Successor reprasmta to the State that, to the best ofits Imowledge, information and behe~ it is not in violation of any of the <br />provisions ofthe Colorado Msned Land reclamation Ad with respect to a~ other operation ctmductedby it in the State of Colorado. <br />Permittee ®d Successor hereby request the Stye to consent to the assignment of the Perini; to recognize Successor as Successor <br />Optrator user the Perini; and to accept the tendered substinne Performance end Financial F+erreniies in place of the Warranties <br />presently am file with the State. <br />
