FORMAL PUBLIC HEARING <br />Consideration/adoption of changes to Rules and Regulations of the <br />Colorado Surface Coal Mining Act, Article 33 of Title 34 C.R.S. The <br />rule amendments have been proposed pursuant to the authority granted in <br />34-33-109 C.R.S. The petition for rule-making was presented to the <br />Board on March 27, 1991. The following amendments will be considered: <br />A) Delete Rules 3.03.3, Termination of Jurisdiction; 4.14(3), <br />Alternative Reclamation Schedules and 5.2.2(8) 8(9); Inspections at <br />Abandoned Sites AND B) Amend Rules 4.05.3(1)(c), (d) 8 (e), <br />4.05.8(1), 4.05.'92 ~) 8 5.04.7(1). (15 minutes) <br />Staff requested that the Board adopt the proposed amendments that were <br />presented at the March 1991 Board Meeting and also adopt a new set of <br />revised regulations. EXHIBIT A, the proposed amendments were <br />presented to the Boar an iscussed. The Division withdrew a proposed <br />amendment to Rule 4.09.2, temporary impoundments, because of some <br />concerns regarding the language. Revised copies of the Regulations <br />will be provided to the Board by inclusion in theirlnotebooks. <br />It was MOVED that the Board adopt the Coal Rules and proposed <br />amendmen s as presented. DISCUSSION ITEM <br />resen emorandum of Understanding (MOU) between MLRD and the State <br />Historic Preservation Office, regarding historic property revie-rs for <br />coal mine applications. <br />Staff presented ATTACHMENT B - MOU with the State Historic Preservation <br />Office for the Boar~eview. The MOU was developed due to OSM's <br />actions causing changes to cultural and historic resource regulations <br />and sets forth the consultation process with the SHPO. Staff discussed <br />this issue further and answered questions from the Bpard. <br />
