Notice of Proposed Decision <br />The Colorado Division of Minerals and Geology has issued a proposed decision to approve Bond Release <br />Application No. 1 (SL-1) and Termination of Jurisdiction for the New Pryor Strip, Permit No. C-1981- <br />031. The affected area is located neaz the town of Pryor in Huerfano County about 1.5 miles west of the <br />Pryor exit (Rouse Road) off of I-25. The permit azea lies within the S W 1/4 Section 19, T29S R65 W. <br />The New Pryor Strip Mine was permitted by Viking Coal Company. The permit was issued effective <br />November 9, 1982 and a bond was submitted. The permit was later transferred to American Fuels, Inc. <br />and operations commenced shortly after and continued in compliance with the Rules for coal mining <br />for approximately one year. In late 1984, the operation went into temporary cessation. Numerous <br />Notices of Violations followed and a Show Cause Order was issued on May 3, 1985. The Mined Land <br />Reclamation Board determined that three patterns of violations occurred and American Fuels, Inc had <br />failed to show good cause why their permit should not be revoked. Therefore, in accordance with <br />C.R.S. Sections 34-33-123(7), 34-33-124(4) and Rules 5.03.3 and 5.03.5(3) mining permit #C-81-031 <br />was permanently revoked by the Mined Land Reclamation Boazd effective Mazch 20, 1986. Although <br />the bond was forfeited, due to bankruptcy of Union Indemnity Insurance Company the Division of <br />Minerals and Geology collected no bond monies. <br />The mine site was reclaimed by the Colorado Mined Land Reclamation Division using money from a <br />grant from the Office of Surface Mining, a branch of the U.S. Department of Interior. Final <br />reclamation was completed on Mazch 18, 1992 for a total cost of $83,260.00. A total of 22 acres was <br />graded to approximate original contour, topsoiled, and revegetated. Stability of the reclaimed land, <br />successful revegetation of grasses and forbs, minimization of hydrologic impacts within the permitted <br />area, and prevention of hydrologic impacts outside the permitted area demonstrate that the site has been <br />successfully reclaimed over the past 13 years. <br />Copies of the proposed decision are available for review at the office of the Colorado Division of <br />Minerals and Geology, 1313 Sherman Street, Room 215, Denver, Colorado 80203, and at the office of the <br />Huerfano County Clerk & Recorder. <br />Any person who has an interest that is, or may be, adversely affected may request an adjudicatory hearing <br />regarding this proposed decision. Requests for a hearing must be made in writing within thirty (30) days <br />of the first publication of this notice, and shall state with reasonable specificity the reasons for the request <br />and objections to the proposed decision. <br />
