<br /> <br />Page 2 9-18-95 Addendum to Sokol pit application ~M-80-193 <br />It is our intent to have open, stripped, only enough area to <br />satisfy our needs for several months. This is not altogether <br />altruistic, but more practical. This 40 acres is projected to last <br />us well into the first quarter of the next century. As our needs <br />vary from year to year some years we will take 20-30 thousand tons <br />from any given pit, by the same token we may not use a pit for <br />several years. Our use is therefore assumed to be approximately <br />two acres per year. Typically the topsoil from the stripped area <br />is placed in such a way and manner that it is easily available to <br />reclaim the area behind us. Thus we have a dynamic pit that is <br />being used and reclaimed at the same time. Any excess topsoil is <br />moved to the boundary of the pit, stockpiled, seeded and ready for <br />the final reclamation. In any case as we exhaust an area it is our <br />practice to reclaim it. If that needs to be spelled out I hereby <br />make that commitment. The problem with showing a phased plan is <br />that we do not know which portion of the face we will be working at <br />any given time. As the material is not uniform we use different <br />material from different areas for different types of jobs. i.e. <br />shouldering, backfilling, or surfacing. Maybe this wasn't clear, i <br />apologize. <br />Exhibit E <br />As stated above as we move toward the northeast we will <br />necessarily have exhausted the boundary on the north, south and <br />some portion of the east wall. As it becomes practical we will <br />reclaim any area where we are at the pit limit. As we will have an <br />open strip of land at the mining face we will keep this rim at a <br />minimum. Typically this area is a hundred to a hundred fifty feet <br />wide. <br />Rainfall in this area is ephemeral and thus most unpredictable from <br />year to year. It has been our experience that we need to seed our <br />reclaimed areas several times to get an acceptable stand of <br />grasses. As an interim solution we often place straw bales along <br />contours to function as benches for erosion control. During the <br />time of year when this area is used for grazing the lessee erects a <br />temporary electric fence around the mining area and thus cattle <br />have not been a problem. If this practice stops I rather imagine <br />we would protect our interest and place a temporary fence around <br />the area. <br />Exhibit F <br />As to the haul roads inside the area. They will indeed be <br />reclaimed. The road depicted to the north serves as access to our, <br />the Department of Transportation, and the Sheriff's, communications <br />tower. This road is used frequently and will not be reclaimed. As <br />a matter of record this road (see the map) is owned by E1 Paso <br />County in fee simple.
