Section 12: Locs 2 to 4, inclusive, SW/4NW/4, and those
portions of SW/4NE/4 and SE/4NW/4 lying north
of the North Fork of the Gunnison River;
containing a total of approximately 1,339.56 acres.
The surface estate of the tract consists of 1,307 acres of public
land and 40 acres of private surface.
As previously noted in Section 2.03.4(9), Oxbow Carbon &
Minerals, Inc. filed an application on October 2, for assignment
of Federal Coal Lease COC-53510 to Oxbow Mining, Inc. as its
successor in interest. The lease assignment application is
• pending Bureau of Land Management approval.
None of the rights, as noted in this section, are the subject of any pending
litigation.

2.03.7 Relationship to Areas Designated Unsuitable for Mining
(1) This paragraph does not apply since the surface operations and mine were in
operation prior to August 3, 1977 and substantial portions of the underground
operations are on Federal lands.
Approximately 6.6 acres within the Sanborn East Tract are unsuitable for
mining because they are within the 100-year floodplain of the North Fork of
the Gunnison River (unsuitability criterion No. 16), according to oral advice
from Lynn Lewis, BLM, Montrose District Office, on March 10, 1992. The
100-year floodplain is located south of old State Highway 133. The Sanborn
Creek Mine is designed so the lateral extent of subsidence will extend no
further south than the north edge of old State Highway 133. Therefore, the
Sanborn Creek Mine will not mine within the 6.6 acres that have been
classified as unsuitable for mining.
