<br />Federal Lands <br />Federal Coal Lease No. COC-53510, dated effective November <br />1, 1992, for the Sanborn East Tract. <br />T. 13 S.. R. 90 W.. 6th P.M. <br />Section 1: Lo[s 14 to 19, inclusive; <br />Section 2: Lots 13 to 20, inclusive; <br />Section 3: Lots 13, 14, 17, and 18; <br />Section 10: Lois 1 and 2, NE/4SE/4; <br />Section 11: Lots 1 to 8, inclusive; <br />Section 12: Locs 2 to 4, inclusive, SW/4NW/4, and those <br />portions of SW/4NE/4 and SE/4NW/4 lying north <br />of the North Fork of the Gunnison River; <br />containing a total of approximately 1,339.56 acres. <br />The surface estate of the tract consists of 1,307 acres of public <br />land and 40 acres of private surface. <br />As previously noted in Section 2.03.4(9), Oxbow Carbon & <br />Minerals, Inc. filed an application on October 2, for assignment <br />of Federal Coal Lease COC-53510 to Oxbow Mining, Inc. as its <br />successor in interest. The lease assignment application is <br />• pending Bureau of Land Management approval. <br />None of the rights, as noted in this section, are the subject of any pending <br />litigation. <br />(2) (a-c) Not Applicable <br />2.03.7 Relationship to Areas Designated Unsuitable for Mining <br />(1) This paragraph does not apply since the surface operations and mine were in <br />operation prior to August 3, 1977 and substantial portions of the underground <br />operations are on Federal lands. <br />Approximately 6.6 acres within the Sanborn East Tract are unsuitable for <br />mining because they are within the 100-year floodplain of the North Fork of <br />the Gunnison River (unsuitability criterion No. 16), according to oral advice <br />from Lynn Lewis, BLM, Montrose District Office, on March 10, 1992. The <br />100-year floodplain is located south of old State Highway 133. The Sanborn <br />Creek Mine is designed so the lateral extent of subsidence will extend no <br />further south than the north edge of old State Highway 133. Therefore, the <br />Sanborn Creek Mine will not mine within the 6.6 acres that have been <br />classified as unsuitable for mining. <br /> <br />Permit Transfer (OCM to OMI) 2.03-9 Revised: 10/17/97 <br />
