Long <br />Grand Junction, CO 81506-3946 D~~ISion Dlrecro~ <br />Re: Bowie No. 2 Mine (Permit No. C-1996-083) <br />Permit Revision Applicafion No. 5 (PR-5) <br />Mine Plan Change <br />Dear Sir or Madam: <br />The Division of Minerals and Geology (DMG) hereby issues notice, in accordance with Tide 34, Article 33, <br />Section 118, Paragraph 3, of the Colorado Revised Statutes, that on May 29, 2001, an application to revise coal <br />mining operations at the Bowie No. 2 Mine was considered complete for the purposes of filing. All review and <br />comment periods as provided in the Act and the Regulations initiate from this date of tiling. <br />Approval of this permit revision would increase the permit boundary to the west by 560 acres and allow for <br />longwall mining west of the present mining, and west of the main fault, but just east of Terror Creek. <br />Additionally, i[ is being proposed that one gob vent borehole and its associated light use road would be <br />cons[mcted. All 560 proposed additional acres are on Federal land and, with this approval, would bring the <br />remainder of [he Iron Point Tract Federal Coal Lease into [he Bowie No. 2 permit. A portion of [he proposed <br />mining had previously been approved as retreat mining of a room and pillar operation. <br />The underground coal mining operation is on land located approximately 5 miles northeast of Paonia, Colorado. <br />The permit area is further described as follows: <br />Portions of Sections 2, 3, 4, 9, (0, 11, 14, 15, and 16, Township 13 South, Range 91 West of the 6th P.M. <br />Portions of Sections 33 and 34, Township 12 South, Range 91 West of the 6th P.M. <br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Bowie. <br />Because the above referenced permit revision application would incorporate additional lands into the permit area <br />or might otherwise alter previously approved permit conditions or mitigation measures, we are requesting your <br />agency's evaluation of the potential for impacts to threatened or endangered species of plants or animals, or <br />wildlife species otherwise protected by federal law. <br />DMG is required to make a finding that "the activities would not affect [he continued existence of endangered or <br />threatened species or result in the destruction or adverse modification of their critical habitats as determined under <br />the Endangered Species Act of 1973...." We request your review and recommendation pursuant to this finding. <br />Applicable sections of the revision application are enclosed. Please advise us if you require additional <br />information. <br />
