Long <br />Din sion Director <br />Adequacy review of <br />I have reviewed the conversion application for the Airport Gravel <br />Pit and have the following adequacy concerns: <br />PAGE 2 OF APPLICATION: There is no entry in the space provided <br />for "Name of owner of subsurface rights of affected land". The <br />quarter section and quarter/quarter location of the pit are <br />also not indicated. <br />A revised Page 2 should be provided with the above information <br />included. <br />EXHIBIT A: If a more complete legal location had been provided <br />on Page 2 of the application, the Division might accept the <br />statement made on Exhibit A, ie. "Legal description previously <br />submitted". Under the existing circumstances, however, <br />reference to a previously submitted legal description is not <br />sufficent. <br />A revised Exhibit A should be provided with a legal <br />description adequate for field location of the property. <br />EXHIBIT C: The information provided does not completely or <br />accurately indicate the surface ownership of all properties <br />immediately adjacent to the property to be mined or, possibly, <br />of the proposed permit area itself. Presumably, the pit is <br />situated partly in the NW 1/4 NW 1/4 of Section 21. According <br />to the listings, however, Frank and Jetta Rose Cantoria are <br />indicated to own some part of the w 1/2 NW 1/4 of Section 21 <br />which could conflict with the ownership of the NW 1/4 NW 1/4 <br />which the County claims and where it intends to mine.
