Wadsworth Blvd. <br />Lakewood, CO BD226 <br />Dear Mr. Peterson: <br />Ne are 1n receipt of your letter of 18 July 1988 in which you address concerns of the Baumgartels <br />In reference to the first concern, please be assured that Sunlend Mining Corporation has no <br />Intention of alienating Its neighbors. Ne will make every effort to comply with all regulations <br />Covering our mining operation end specifically those stipulations es specified by the Colorado Mined <br />Land Reclamation Division end the Bureau of Lend Management, USDI. <br />As you ere aware, Sunland is leaseholder of C-0127592 coal lease with the BLM, which covers 80 <br />acres, more or less, contained within SE/4, NN4 and NE/4, SN/4 of Sec. 22, T4N, R86N, 6th PM, Routt <br />County Colorado. Approximately 40 acres of this lease underlies the surface of the property identified <br />as the "Baumgartel property" 1n your letter. Ne have no routine need for surface access to this portion <br />of our lease under normal operation of our Apex No. 2 mine. Inasmuch as the Apex No. 2 mine is <br />currently not producing, we presently have no need of surface access to this area at ell. Nhen (and <br />if) operation of the Apex No. 2 mine is ~ resumed, we will certainly advise the Baumgartels of any <br />unforseen situation which might necessitate our need for surface access. <br />As to the second concern, please be assured that underground mining activities within the <br />aforementioned lease will be done in accordance with the BLM lease provisions and State and Federal <br />regulations. No mining is anticipated under any presently existing surface improvements on the <br />"Baumgartel property". All of the Pinnacle Seam recoverable reserves in the subject portion of our <br />lease are north (northwest, actually) ~of Routt County Road 129. The land surface in this area is <br />mostly steep hillside. Explosives are not routinely employed in our mining operation. <br />Having expressed that we have no present intention to conduct the activities of concern to the <br />Baumgartels, we wish tt understood that nothing in this letter should be toY.en as a relinquishment <br />of any legal or contractual rtghts which we may have to conduct those activities. <br />A copy of the renewal application to MLRD is en[loded.
