<br />CUP 97-2 COALDALE/DISTRICT #3 <br />RESOLUTION PAGE 2 <br />adversely affect other property in the vicinity or the <br />general health, safety and welfare of the inhabitants of <br />the county, and will not cause significant air, water, <br />noise or other pollution. <br />2. A Conditional Use Permit shall be issued contingent on the <br />acceptance and observance by the' Applicant of the following <br />specified conditions: <br />1. Conditional Use Permit be issued for life of the mine. <br />2. The. Planning Department will review the. permit at the end of <br />one (1) year to determine compliance with the conditions of the <br />permit and forward it to the Board of County Commissioners for <br />their review as required by regulations_ <br />3. Applicant shall conform to all plans, drawings and <br />representations submitted with or contained within the <br />application except as may be inconsistent with the other <br />provisions of the permit. <br />_ 4. Applicant shall comply with all laws and regulations of the <br />State of .Colorado, its...agencies or departments, the Board of <br />County Commissioners of Fremont County,. and the United States <br />of America, its agencies or departments, as now in force and <br />effect or as the same may be hereafter amended. <br />5. Applicant shall obtain and keep in effect all other permits <br />required by any other governmental agency and as otherwise may <br />be required by Fremont County. Revocation, suspension or <br />expiration of any such other permits shall revoke, suspend or <br />terminate the permit authorized hereunder, as the case may be. <br />6. The applicant shall provide the Fremont County Department of <br />Planning and Zoning with copies of any technical revisions to <br />its Mined Land Reclamation permit, and with any copies of any <br />and all annual or other mining reports required by any <br />governmental agency. <br />7. All loads of material transported from the site shall be <br />secured to prevent any material from escaping in accordance <br />with C.R.S. 42-4-1208 as amended. <br />8. Notwithstanding, the term for which this permit will be issued, <br />the permit shall be subject to additional review by the Board <br />of County Commissioners at its discretion and during any such <br />review the Board may consider, if warranted in the judgment of <br />the Board, the impact of the use upon traffic patterns and <br />volume in the area to include setting additional or different <br />conditions regarding access to the area and to designate routes <br />which trucks and traffic to and from the site are to use. <br />0 2 97 03:4 1288 P8 447 <br />2 of 3 R 0.00 D 0.00 N 0.00 FREMONT COUNTY, CO <br />
