Kiger Senior Environmental Specialist Colowyo Coal Company 5731 State Highway 13 Meeker, CO 81641 RE: Colowyo Mine, Permit C-81-019 PR-O1; Excess Spoil Fills: Response to Geotechnical Adequacy Dear Mr. Kiger: The Division has completed its review of Colowyo's revised submittal of Exhibit 19: West Pit Excess Spoil Fill. The Division's comments are as follows: 1. In the "Reclamation Plan" section of Exhibit 19, a reference is made to an "attached Map" that would show details of the construction of the fill. We are unable to find such a map Please submit a map detailing construction of the fills, certified according to the standards of Rule 2.10. 2. Colowyo has satisfied all of the underdrain design requirements of Rule 4.09.2 except subsections (2)(c) and (3)(c) which require the design and construction of a filter system to protect the underdrain from contamination. Colowyo has not given sufficient evidence to support its contention that gravity segregation of spoil will result in the creation of an acceptable filter system. Colowyo will have to amend its application to include designs for the construction of a filter system to protect the underdrains (Other operators have used a variety of techniques to protect underdrains, from graded materials to geotextile fabric). 3. In the "Inspection Plan" section of Exhibit 19, Statement 1, a reference is made to the possibility of non-bedrock conditions at the toe of the Section 16 Fill. Colowyo will need to amend this statement to read: "any amended design will be submitted to the Division for its review and approval, prior to construction of the fill".
