C-9G-083) <br />Permit Revision Application No. 3 <br />ik:ar Mr. Routten. <br />97075307 <br />P-O1 <br />III IIIIIIIIIIIII III <br />l7n behalf of the members of the Western Slope F:nvironrnenral Resource Council (WSERC), I am writing to <br />formally protest the failure of Bowie Resources Ltd.. to timely file Permit Revision Application No. 3 fur their <br />Ruwie No. 2 Mine (Permit No. C-9G-083) in the llelta County Cotrtthouse ac +tatod in the public notices and in dre <br />letter of notification we rta;ived May 31, 1999, from the Colorado Divisi,m of Minerals and Creology. <br />As documented in the aztached letters from WSERC members, nn copy o[ PR#3 was placed on file for public <br />inspu;tion until nn or after July 15'", after approxhnately three-quartets of the public review period had pacsed. Prior <br />to that date our members twice wen[ down to the ci,urthouse to inspec,-t this document, only to find that it wac not <br />them. We consider this is a very serious violation of state and federal mining laws, and nor rights as affected citizens. <br />As a recult, we have been unable to thoroughly review PR#3. This is a very long and complex document. Yct instead <br />of the full GO Jays for review, we have had just two weeks to inspect il. <br />Additionally, our members repot other complicating factors: <br />• documents are filed among various other and older permit applications, resulting in some confusion and <br />difficulty in tt;sc:uch; <br />• documents arc located 30.40 miles from the mine site and our community, and are only available during limited <br />business hours; <br />• the location i. a crrmped fireproof vault with minimal work space, and is exlrc:mely busy due to the fact that all <br />title research in the county a;curs in the xame small room. Compounding this is the high cost of making copies at <br />the Counry Cuttrthouse (25¢ ea. page and SS per map page). <br />our second concern is the format of PRM3. Apparently, ntnst revisions show deletions and additions, using standard <br />typographic tools such as strikcthrough and underline fonts. PR#3 does not use this convention, and it is next to <br />impossible to compare the proposed revisions to the original permit. Thus, the document is not in a readable format. <br />As citizens whose pmpcrty, water rights and quality of life will be directly affected by this proposal, we strenuously <br />object to this situation. We believe that dre failure to have readable documents on file and publicly available as stated <br />in the public notice violates state statutes, and as such the proces, should start over, dating from the time the <br />application was actually delivered to the County Coarthousc. If this request is not granted, we then request an <br />oppnmurity u, discuss the problem with the state Roard of Mined Land Reclamation.
