12/20/2002 16:59 9702260204 TSTINC PAGE 06 <br />December 11, 2002 <br />Mr. Jeff Deatherage <br />Office of the State Engineer <br />Division of Water Resources <br />1313 Sherman SL, Room 818 <br />Denver, CO 80203 <br />Re; Timberline Lakes, File No. M--1977-184, Amendment to testing Permit <br />Project No. 978-001 <br />Dear Mr. Deatherage: <br />I am writing this letter to summarize our wnversation on December 3, 2002 about the <br />issues surrounding the application for amendment to the Timberline Lakes Site, file <br />number M-1977-184, with the Division of Minerals and Geology. The intent of the <br />amendment is to change the reclamation plan for a portion of the site and the post <br />mining land use for that portion from recreation to industriaUcommercial. The existing <br />mining permit is held by the City of Fort Collins. The parcel owners representative, <br />David Neenan, wiU be working in conjunction with the permit holder to make the changes <br />as described in the application. <br />We have filed the amendment to the application with the Division of Minerals and <br />Geology and received a comment from your office stating that a new well permit and <br />plan for augmentation, or a substitute supply plan for the new proposed uses will be <br />required. Our amendment proposes filling in a portion of one of the existing ponds, <br />reducing the exposed surface area of that pond from 12.7 Acres to 6.26 Acres. <br />Our concern is that the City of Fort Collins Natural Resouros Department, the <br />Successor of Operetor of the site, has told us that a substitute supply plan, an <br />augmentation plan and/or a new well permit will not be prepared prior to the decision <br />date for the appllption, January 4, 2003. <br />We are requesting guidance and assistance in this matter so that we may satisfy your, <br />and the DMG's, requirements as quidcty as possible. Please feel free to give me a call to <br />discuss these issues in more detail. For your convenience, I have enclosed a copy of <br />the reclamation plan and a vianity map of the permit area to be amended.
