Cottony <br />Re: Preliminary Adequacy Review, RN-04, New Horizon Mine 2, Permit No. C-81-008 Division Director <br />Deaz Mr. Gubka: <br />The Division has completed portions of the preliminary adequacy review of your recent permit renewal. The sections <br />that have been reviewed include 2.03 Legal, Financial, Compliance, and Related Material; 2.04.(5-6-7) Ground Water <br />Hydrology/Geology; 2.04.9 Soils; 2.05.3 Topsoil Removal & 2.05.4 Topsoil Redistribution; 2.04.10 Vegetation; 2.06.3 <br />Mining Operations to include Surface Water, Roads, etc; and section 2.05.4 Revegetation Plan. One area that is still <br />under review is the section on blasting. Comments on this topic will be forthcoming in about 1-2 weeks. Review of the <br />worst case bonding scenario was completed with the recent bond release SL-07 and the remaining bond amount is <br />sufficient to complete all reclamation activities. <br />The following issues will require additional information, correction or action. If any of the issues will require an <br />extended period of time before a response can be submitted, please hold those items in abeyance and submit the other <br />actions in a timely moaner. <br />LEGAL AND FINANCIAL SECTION: <br />1. For Tri-State Generation, pages 2.03-4 & 2.03-5, please revise to show all current officers and directors (see <br />attached). <br />SURFACE WATER: <br />1. Designs for the ditch that runs from the south west corner of the mine, adjacent to Mr. Burbridge's house, to <br />Pond 7 needs to be revised and submitted as a minor revision. <br />SMALL AREA EXEMPTIONS: <br />1. A pazagraph needs to be added to the "Running Pond SAE" section that states each pond will be adsorbed by <br />the advancing pit, therefore, will not need reclamation. Additionally, a new running pond will be installed just <br />prior to the topsoil removal campaign that moves ahead of the existing SAE pond. <br />BLASTING: <br />1.
