-facsimile <br />TRANSMITTAL <br />to: Daniel Hernandez, Colorado Division of Minerals and Geology <br />fax #: danicl.hcrncndcz~d;stataco.us (303) 866-4933 <br />re: RAG Twentymile Coal Company, "Foidel Creek Mine MR-167" <br />date: 02/01 /00 <br />pages: 1 (one), including this cover sheet. <br />This electronic transmittal is in response to your January 31, 2000 fax and our <br />conversation regarding the above subject. <br />The Office of Surface Mining Reclamation and Enforcement (OSM) has reviewed the <br />material associated with this minor revision and has determined that it involves the <br />reorientation of the Northwest Mains to allow for increased pillar stability, and a <br />widening of the pillars in the southern most entry for the initial 1,000 feet of the I 1 Right <br />gateroad. As a result of the reorientation, approximately 90,636 mineable tons of <br />Federal coal will be added to Federal lease COC-54608. Of that amount, 56,194 <br />recoverable tons of additional coal will be produced from Federal lease COC-54608 with <br />a corresponding decrease in the amount of coal being mined from the adjacent fee coal. <br />OSM has determined that this minor change in the amount of coal mined from Federal <br />lease COC-54608 does not require a mining plan modification approval by the Secretary, <br />in accordance with the Federal regulations under 30 CFR 746.18(c)(1) and 30 CFR <br />746.18(d)(3)(i). <br />If I can be of further assistance regarding this matter, please feel free to contact me by any <br />of the methods listed at the right. <br />From the desk of... <br />Carl R.
