/ ~ <br />j <br />Rider and Stipulation to <br />Colowyo Mine Permit Revision No. 1 <br />July 14, 1992 <br />Discussion: On July 11, 1992 the Office of Mined Land Reclamation's Decision <br />to approve Permit Revision Number 1 became final. This Revision, which <br />increased the mining area and permitted excess overburden disposal, <br />encompassed both Federal and Non-Federal lands. <br />The Cooperative Agreement entered into between the State of Colorado and the <br />U.S. Department of the Interior requires the Secretary of the Interior to <br />approve mine plan revisions on Federal Lands. The Office of Surface Mining <br />has indicated that Secretarial approval would not be forthcoming until early <br />August, 1992. This delay of approval conflicts with the operational schedule <br />for the mine site, causing serious economic burden for the permittee. <br />Due to the above facts, and because the Office of Mined Land Reclamation has <br />approved the permit revision and adequate bond has been accepted, and because <br />a portion of the revision area does not encompass federal lands, the following <br />stipulation is necessary. <br />Stipulation <br />Colowyo Coal may initiate mining operations on non-federal lands within <br />the approved Permit Revision area prior to receiving Secretarial approval <br />for the mining of federal lands. <br />4084E <br />
