The mine is referred to as the <br />Bluestone Expansion. <br />The Division conditionally approved the permit on April 26, 1995. The financial warranty was <br />set at 5428,307.00 for 80 acres of disturbance (or S5,354 per acrel. Western Aggregates, <br />Inc. (WAl) has no dispute with this bond calculation. <br />The Jefferson County Commissioners approved mining on only 22.8 acres of the Bluestone <br />Expansion. All the remaining acreage (101.2 acres) is subject to moratoriums of at least five <br />(5) years for a variety of reasons. <br />WAI does not want to bond for 80 acres when they can only mine 22.8 acres in the <br />foreseeable future. Thus the TR to reduce the bond amount. <br />The only activity proposed on the expansion area is mining, reclamation end transport of pit <br />run materials back to the permanent processing plant, which is located on the originally <br />permitted land (Permit No. M-91-035). The bond calculation on the expansion area was based <br />on grading and shaping, topsoiling, seeding and mulching. There was no amount calculated <br />for processing plant removal. <br />The attached map shows the 22.8 acres that WAI wished to bond (identified as Phases 2A <br />and 3A). We believe it is acceptable to apply the 55,354 per acre figure to that acreage for <br />a total rnaw bond of 5122,071.00.
