Based on recent conversations with the applicant, Preble's Meadow Jumping Mouse has been <br />trapped within the permit area of the Lyons Pit Amendment area. Please inform the Division the <br />status of the Preble's study, and what issues have been discussed between the applicant and the U.S. <br />Fish & Wildlife Service. Please be aware that the applicant is required to follow all County, State <br />and Federal Laws regazding threatened or endangered species. <br />Rule 6.4.10 Exhibit J- Veeetation Information <br />38. The applicant identified wetlands on the exhibits submitted to the Division. Please be awaze that <br />wetlands can not be distwbed until the Department of the Army, Corps of Engineers issues a permit. <br />Please commit in writing that no wetlands will be disturbed until the Department issues the <br />appropriate permit. <br />Rule 6.4.12 Exhibit L- Reclamation Costs <br />39. The Division will estimate the cost to reclaim the site once the applicant addresses the concerns <br />noted in this letter. <br />Rule 6.4.14 Exhibit N- Source of Legal Right to Enter <br />40. Please provide documentation for legal tight of entry on all property owned by Mineral Reserve, Inc. <br />and Western Paving Construction. Please be awaze that easement holders of property throughout the permit azea need to meet the same <br />requirements as the surface owners. Specifically, easement holders need to be identified on a Map, <br />Western Mobile must provide documentation of legal right of entry into the easement property, and <br />notify all easement holders within 200 feet of the affected azea of the mining and reclamation <br />activity. <br />The following easement holders were noted in the application, but this list is not conclusive; <br />Burlington Northern Railroad, Boulder County (Roads), Utility Easements and Ditch Easements. <br />Please address. <br /> <br />
