Said proceeds shall be used by the Division for <br />reclamation of the area covered by the bmd. Said reclamation <br />shall include all costs and administrative expenses associated <br />with the condJCt of the applicable reclalmtion activities <br />required by 4.21, Forfeited amounts received by the Ofvision in <br />excess of such costs and expenses shall be refunded to Ltie <br />person resp~nsi6le ar to the surety. whid~ever is appropriate. <br />(4) Determination of the forfeiture amount. <br />The Board shall either: <br />(a) Determine the amount of the bond to be <br />forfeited on the basis of the estimated cost to the Oiviston or <br />its contractor to camel ete the reclamation and other regilatary <br />requirements in accordance with these Rules; or <br />(b) Declare forfeited the entire amount of the <br />bend for which liability 15 outstanding. <br />3.06 SPECIAL BONDING REWIREIIENTS fOR CONSTRUCTION OF MUTE <br />DRAINAGE CONTROL FACILITIES <br />3,06.1 Bond Requirements. <br />Performance bond iiability shall include construction of <br />lmpounanents, conveying systems, and treatment facilities for <br />mine drainage planned in accordance with 4.05.2. 4.05.8, and <br />4.05.10. Bond liability with respect to mine drainage shall <br />extend to the construction and ultimate removal of facilities <br />described in the permit application or recamation plan as <br />associated with the treatment of mine drainage. The bond amount <br />determination made under 3.02,2 shall not include continuous <br />treatment, mmitaring, or potential unp-edictable expenses <br />resulting from mine drainage. <br />
