of the Section 14. Northfield has received right-of--entry approval from the Cotter Corporation <br />to use the road segment". <br />In accordance with Rule 2.02.2(2)(e), please provide a description of this right-of--entry <br />approval from Cotter Corporation. Please describe whether this right of entry is a lease signed <br />by both parties, an easement signed by both parties, or some other written form of approval. <br />Please describe the beginning and end dates of this approval. <br />If it is desired that this lease information be kept confidential, please indicate, in accordance <br />with Rule 2.02.8(2)(a), how this lease information is a trade secret or privileged commercial or <br />financial information that relates to the competitive rights of the person or entity intending to <br />explore the described azea, and submit this information cleazly mazked in a packet separate <br />from the amendment application. <br />2. The amendment application and map indicate that the road providing access to the new NF-04 <br />drill site will cross an ephemeral drainage at least once, if not twice. Please note that Rule <br />4.21.4(3)(b) states that "any new road used for coal exploration, or any existing road which is <br />significantly altered for use in coal exploration, shall comply with the provisions of (Rules) <br />4.03.3 and 4.04. A road is significantly altered if it is widened, if the route or gradient is <br />altered, or if the road is otherwise upgraded". Depending on the degree of disturbance, <br />installations of new culverts in an existing road could be considered an upgrading of a road. <br />In accordance with Rule 2.02.2(2)(g), therefore, please describe whether the ephemeral <br />drainage crossings of the road to the NF-04 drill site will require culverts, and if so, the <br />number, length and diameter of the culverts, and their locations on the amendment map. <br />3. The amendment map indicates that the NF-04 drill site will be situated within an ephemeral <br />drainage. In order to better comply with the requirements of Rules 2.02.2(2)(f) and 4.21.4(10), <br />we request the NF-04 drill site be located outside of this drainage. If relocation of this <br />proposed drill site is acceptable, please identify on the amendment map the new location of the <br />NF-04 drill site. <br />4. In accordance with Rule 2.02.2(2)(g), please describe whether any mud pits will be needed in <br />conjunction with the drilling of the four holes proposed under this amendment application. <br />5. In accordance with Rule 4.21.4(5), please provide a description of how the A and B soil <br />horizons from the NF-04 drill site will be salvaged and protected from excessive wind and <br />water erosion. Please also provide a description of whether similar salvaging and protection of <br />underlying subsoils will be necessary, and if so, how this will occur. If subsoil salvaging will <br />occur, please describe how replacement of subsoils and the A and B horizons will occur. <br />6. In accordance with Rule 4.21.4(10), please describe whether drilling of the four new boreholes <br />is expected to encounter any significant amounts of groundwater, and if so, whether discharge <br />of this groundwater to the surface may occur. Please describe whether any permits from the <br />Water Quality Control Division of the Colorado Department of Public Health and Environment <br />may be needed for this potential water discharge. <br />
