EXHIBIT P - Owners of Record of Surface <br /> and Subsurfaces Rights C(See 34-32-112(2)(b)&(c)] <br />Performance and Financial Warrz~nties <br />You must submit a performance warranty and a financial warranty in an amount determined <br />by the Board prior to permit i<_;suance.* Several different types of financial warranty <br />are allowed by the law. You should determine what type of financial warranty you desire <br />to use and obtain the appropriz~te forms from the Mined Land Reclamation Division during <br />the application review period t:o facilitate finalization of an acceptable financial <br />warranty and permit issuance. <br />Compliance with Other Laws <br />Section 115 of the Act requires. a permit application be in compliance with all <br />applicable local, State and Federal laws. We suggest you contact the following agencies <br />to determine whether you need to comply with their legal requirements: <br />State Engineer with regard to the administration of water rights; <br />Colorado Department of Health with regard to the discharge of pollutants into the <br />waters of the State; <br />Colorado Department of Health with regard to the need for a fugitive dust permit; <br />and <br />U.S. Army Corps of Engineers regarding a dredge and fill permit. <br />*If the applicant is a unit of State or county government, then only a performance <br />warranty is required. <br />(Rev. 6/86) <br />1250E <br />
