Linden '~ <br />Assistant Attorney General <br />Colorado Attorney General's Office <br />1525 Sherman 5th Floor <br />Denver, Colorado 80203 <br />RE: Approval of Settlement Agreement by Colorado Wildlife Com- <br />mission <br />Dear Mr. Long, Mr. Walker, and Ms. Linden: <br />Please be advised that on June 10, 1994, the Colorado Wildlife <br />Commission approved the May 26,.1994, Settlement Agreement en- <br />tered into by Colorado Yampa Coal Company, the Colorado Division <br />of Wildlife, and the Colorado Division of Minerals and Geology to <br />settle the Matter of Colorado Yampa Coal Company pending before <br />the Colorado Mined Land Reclamation Board (Case No.C-81-071); and <br />more specifically the acquisition by the state wildlife agencies <br />of the perpetual conservation easement in gross provided for in <br />that settlement agreement. <br />As you are aware the wildlife agencies' acquisition of a perpetu- <br />al easement is subject to review and comment by the General <br />Assembly's Capital Development Committee pursuant to the provi- <br />sions of subsection 33-1-105(3), C.R.S. (1993 Supp.). The June <br />10 approval action by the Wildlife Commission was made expressly <br />subject to a favorable recommendation by the Capital Development <br />Committee.
