The amendment <br />increased permit boundaries from 420 acres to 830 acres and increased bonding liability <br />by $1,344,200. ,~ ~ ~ '/ 4 ?~ °~ <br />Subsequent to this amendment approval, the Mined Land Reclamation Division <br />issued a Boazd Order on January 24, 2002 that extended the deadline for posting of the <br />financial warranty until the end of calendaz yeaz 2005 - or prior to any actual disturbance <br />in the amended area. The Board Order also contained a stipulation requiring American <br />Gypsum to provide notice to the Division three months prior to any actual amended area <br />disturbance. This stipulation was included to allow the Division to recalculate the <br />bonding requirement if seen necessary. <br />Pursuant to the provisions outlined above, I am providing notice that American <br />Gypsum wishes to begin road construction into the amended azea during the upcoming <br />fall of 2003.
