damaged by the operation. You have not satisfied the requirements of Exhibit L with the exhibit supplied as Exhibit L
in your response and you have not indicated where in the original application the information necessary to satisfy the
requirements of Exhibit L is to be found.
Please provide the information necessary to satisfy the requirements of Exhibit L in an exhibit properly labeled Exhibit
L or clearly identify where in the original application the information necessary to satisfy the requirements of Exhibit L
is to be found.
NOTE: The Division is aware that in his response the applicant inadvertently identified the Exhibits as required by
Rule 6.4 for 112 permit applications rather than by Rule 6.3 which applies to 110 applications. Nevertheless, the
exhibits submitted in conjunction with an application to amend a 110 permit must be properly identified and must
speak to the requirements of exhibits for 110 applications in order that this amendment application can be considered
filed. The applicant is reminded that Construction Rule 1.4(8) specifies that an applicant has sixty (60) days from an
Office notice of deficiencies in an application to submit all the necessary documents that the Office needs for the
application to be considered filed or the application will be denied and the application file terminated. The original
notice of deficiencies in Exhibits B, C, E, F, G, H, I, J, and L of this application was dated April 25, 2002.
Consequently, these deficiencies must be satisfactorily addressed by June 24, 2002 in order to avoid an automatic
denial of the application.
If you have any questions on the above, please contact me.
Sincerely,
James C.
