Page 130 <br />Construction Materials Rule 6 <br />I15(4)(e) Where the mining operation will adversely affect the stability of any significant, <br />valuable or permanent man-made structure located within two hundred (200) <br />feet of affected land, the Applicant may either: <br />(a) provide a notarized agreement between the Applicant <br />and the Person(s) having an interest in the structure, that the Applicant <br />is to provide compensation for any damage to the structure; <br />(b) where such an agreement can not be reached, the <br />Applicant shall provide an appropriate engineering evaluation that <br />demonstrates that such structure shall not be damaged by activities <br />occurring at the mining operation; or <br />(c) where such structure is a utility, the applicant may <br />supply a notarized letter, on utility letterhead, from the owner(s) of the <br />ut>7ity that the mining and reclamation activities, as proposed, will have <br />"no negative effect" on their utility. <br />u2 6.4 SPECIFIC EXHIBIT REQUIREMENTS - 112 RECLAMATION <br />OPERATION <br />6.4.1 EXHIBIT A -Legal Description <br />The legal description must identify the affected land and be wholly adequate for <br />field location of the property. It can be in the form of metes and bounds survey <br />or a description by reference to township, range and section to at least the <br />nearest quarter quarter section. Where applicable, the street address or lot <br />numbers maybe used. <br />6.4.2 EXHIBIT B -Index Map <br />An index map showing the regional location of the affected land and all roads <br />and other access to the area. A standard U.S. Geological Survey topographic <br />quadrangle or equivalent is acceptable.
