~FARGE j~~' <br />NORTH AMERICA <br />AGGREGATES, CONCRETE <br />& ASPHALT <br />August 29, 2006 <br />~ECE'VED <br />w ~~ <br />e ~~ ~m 1 SEP 0 6 2006 ~ <br />Division of Reclamation. <br />Mmm9 and Safety <br />Colorado Division of Reclamation, Mining, and Safetyf <br />1313 Sherman St., Room 215 <br />Denver, Colorado $0203 ~ ~ - ~I7/ <br />L/~ <br />Re: Nelson Pit, Permit No. M-1974-070 Partial Release Request ~~ , <br />To whom it may concern: <br />Lafarge West, Inc. would like to request a partial release from performance and financial <br />warranties at the Nelson Pit (Permit No. M1974070) located in portions of Section 20, 29 and 30, <br />Township 2 North, Range 68 West in Weld County, Colorado. <br />The portion of the property that Lafarge would like to request release on includes the <br />northernmost section as well as a portion of the property slated for oil and gas drilling by KP <br />Kauffman Company, Inc. <br />The northernmost section of the property as referenced above includes an azea that begins at an <br />E-W drainage ditch and extends north from the ditch to the northern property boundary. This <br />portion of the Pit was mined and reclaimed during the initial phases of the Pit's life and the <br />property owner, Leslie Williams, wishes for it to be released. This area is denoted in Exhibit A. <br />The northernmost section also includes an area planned to be disturbed by KP Kauffman <br />Company, Inc. KP plans to twin a well located on the western edge of the property directly <br />adjacent to the Gooding Dailey and Plumb Ditch. This requires disturbing an approximately <br />3.02 +/- acre area that Lafazge has already reclaimed. Lafarge does not wish to be responsible for <br />reclaiming this area again following the completion of the drilling, particularly if oil and gas <br />reclamation standards are not equivalent to those required by the Division of Reclamation, <br />Mining, and Safety. This area is denoted in Exhibit B. (Release area highlighted in yellow.) <br />Lafazge has worked and continues to work closely with the landowner and this request for partial <br />release is being submitted per his request.
