Mmm9 and Safety Colorado Division of Reclamation, Mining, and Safetyf 1313 Sherman St., Room 215 Denver, Colorado $0203 ~ ~ - ~I7/ L/~ Re: Nelson Pit, Permit No. M-1974-070 Partial Release Request ~~ , To whom it may concern: Lafarge West, Inc. would like to request a partial release from performance and financial warranties at the Nelson Pit (Permit No. M1974070) located in portions of Section 20, 29 and 30, Township 2 North, Range 68 West in Weld County, Colorado. The portion of the property that Lafarge would like to request release on includes the northernmost section as well as a portion of the property slated for oil and gas drilling by KP Kauffman Company, Inc. The northernmost section of the property as referenced above includes an azea that begins at an E-W drainage ditch and extends north from the ditch to the northern property boundary. This portion of the Pit was mined and reclaimed during the initial phases of the Pit's life and the property owner, Leslie Williams, wishes for it to be released. This area is denoted in Exhibit A. The northernmost section also includes an area planned to be disturbed by KP Kauffman Company, Inc. KP plans to twin a well located on the western edge of the property directly adjacent to the Gooding Dailey and Plumb Ditch. This requires disturbing an approximately 3.02 +/- acre area that Lafazge has already reclaimed. Lafarge does not wish to be responsible for reclaiming this area again following the completion of the drilling, particularly if oil and gas reclamation standards are not equivalent to those required by the Division of Reclamation, Mining, and Safety. This area is denoted in Exhibit B. (Release area highlighted in yellow.) Lafazge has worked and continues to work closely with the landowner and this request for partial release is being submitted per his request. Also enclosed in this letter are photos of the areas to be considered for release, along with the required list of names, addresses, and phone numbers of all owners of record of the affected land, and the signed statement.
