S,~ _ n( Natural Resource Trustee <br />Dear Mr. Williams: <br />On December 20th, 2004, the Division of Minerals and Geology staff notified Cotter Corporation <br />that the above referenced site had an increase in the amount of Financial Warranty required to <br />meet liabilities. Please find enclosed the cover letter of that Notice of Increase for the JD-7 Pit. <br />To date, the Division has not received a bond increase or documentation from DOE. <br />The Division's current estimate to complete reclamation at the site is now estimated at <br />$1,245,000.00. This is a $39,000.00 increase over the total bond amount held by the Division <br />and the Department of Energy. Clearly, the site is now currently under-bonded. Therefore, <br />pursuant to Section 34-32.5-117(4) of the Colorado Land Reclamation Act, adequate financial <br />warranty must be submitted to DMG within 60 days of the mailing date of this report. The 60th <br />day will be February 18th, 2005. <br />Cotter has the choice of providing the Division with documentation that the bond held by the <br />D.O.E. has been increased by $39,000.00 or it may submit a bond in that amount to the <br />Division.
