Several structures and other features that are not addressed in the approved mining or <br />reclamation plans are located in the permit boundary. <br />Corrective Action: These features must either be removed from the site or an <br />amendment to the permit must be filed addressing incorporating these features into <br />the permit area and specifying a post mining land use that will allow these features to <br />remain on the site. Correction Date 3/14/2003 <br />Oaerator Response: <br />The operator is new to the gravel mining business and is very apologetic for being in <br />violation of the permit conditions. He has inadvertently constructed his residence and <br />attached garage within the permit boundary, all within his own legal property <br />holdings. <br />In lieu of doing an Amendment Permit application, the operator is asking to provide <br />Technical Revision to reduce the permitted acreage from 9.76 to 6.99 acres and <br />remove the affected acreage (2.77 ac) that has been permanently transformed into <br />residentiaUindustrial use. The propane tank for the residence will be relocated out of <br />the revised permit area. A tentative map depicting this request is attached. <br />The landowner is demonstrating his commitment of reclaiming all disturbed areas <br />now in residentiaUindustriai use by the extent of reclamation efforts as stated in # 1 <br />above. There are no land use restrictions or permits required in Delta County for a <br />property owner to utilize his property in this manner. The operator owns additional <br />property to the north and can provide separate access for the residentiaUindustrial <br />portion if necessary. <br />The operator is asking fora 60 day extension to prepaze the necessary final <br />documents and have maps revised. <br />I thank you for your time and consideration of this request and look forward to working <br />with you to bring this facility back into compliance.
