I973, 34-32-101 et seg. (the "Act"), <br />as amended, provides that no permit tray be'issued under the Act until the Mined Land Rxlamadon <br />Board (the 'Board') receives a Fuurtcial Warranty (or Warranties) as descn'bed in the AcL <br />WHEREAS, ~~ il<anitm ~ ~ (the "Operazor"), <br />a Delaware corporation, has applied for a permit to conduct a mining <br />operation known as Sl=r$v DlirJe (the "Operation"), on certain lands <br />in S3rr Dtiat~l County, Colorado. These lands aze descnbcd in the permit <br />application, as amended and supplemented, and are referred to herein as the 'Affected Lands`. <br />wHERF:AS, in the application for oho permit, the Operator has agreed to be bound by all <br />requiremetus of the Act and all applicable rules and regulations of the Boazd, as amended from time to <br />time. <br />WF~REAS, in the applicaion for the permit, the Operator bas agreed with the Board to provide <br />for reclamation of the Affected Lands that arc now, or may become, subject to the permit, as required <br />by law. <br />
