Cattany <br />Division Direcor <br />Natural Resource Trustee <br />RE: West Tennessee Pit; Permit No. M-1981-235 <br />Webster Sand & Gravel; Financial Warranty Increase (5~'p~ <br />Dear Mr. Webster, <br />Thank you for your letter of May 3, 2005 outlining the steps that will be taken to reduce the reclamation <br />bond liability at the West Tennessee Pit, Permit No. M-1981-235. Based on our meeting of May 3, 2005, <br />and further outlined in your letter, Webster Sand & Gravel will conduct the following to reduce the <br />reclamation bond liability; <br />1. haul in additional topsail from the Homestake Trout Club and store for future reclamation of the <br />site, <br />2. remove the old scrap, debris, old sheds, empty oil barrels from site and keep any used oil offsite <br />(operator indicated there is a garage in town used by the operator), and <br />3. reduce the pit highwalls to 2h:ly to 3:1v. <br />Due to the presence of snow cover and the short work season, the Division will give the operator until <br />August 31, 2005 to complete the reclamation noted above. Please submit documentation of reclamation <br />conducted in the form of photographs. In addition, the operator will need to demonstrate that the <br />Homestake Trout Club topsoil is suitable as a topsoil growth medium in the form of standard soil tests. <br />Such demonstration will need to be submitted in the form of a technical revision to the permit. The <br />Division will then revise the reclamation cost estimate to take into account remaining reclamation of the <br />site. At that time, the operator will be required to post any additional financial warranty required by the <br />Division. <br />Currently, this matter is set for a hearing for the June 14 and 15, 2005 Mined Land Reclamation Board <br />Hearing. The Division will continue this matter to the September 14 and 15, 2005 hearing to allow the <br />operator sufficient time to carry out the proposed plan. When the reclamation has been completed and <br />any increase to the bond has been posted, the Division will consider withdrawing the notice of possible <br />violation. <br />If you have any questions about this process or how the bond was calculated, please contact me at (303) <br />866-4943. <br />Si erely, ~~ <br />Enca S.
