Based on our meeting of May 3, 2005,
and further outlined in your letter, Webster Sand & Gravel will conduct the following to reduce the
reclamation bond liability;
1. haul in additional topsail from the Homestake Trout Club and store for future reclamation of the
site,
2. remove the old scrap, debris, old sheds, empty oil barrels from site and keep any used oil offsite
(operator indicated there is a garage in town used by the operator), and
3. reduce the pit highwalls to 2h:ly to 3:1v.
Due to the presence of snow cover and the short work season, the Division will give the operator until
August 31, 2005 to complete the reclamation noted above. Please submit documentation of reclamation
conducted in the form of photographs. In addition, the operator will need to demonstrate that the
Homestake Trout Club topsoil is suitable as a topsoil growth medium in the form of standard soil tests.
Such demonstration will need to be submitted in the form of a technical revision to the permit. The
Division will then revise the reclamation cost estimate to take into account remaining reclamation of the
site. At that time, the operator will be required to post any additional financial warranty required by the
Division.
Currently, this matter is set for a hearing for the June 14 and 15, 2005 Mined Land Reclamation Board
Hearing. The Division will continue this matter to the September 14 and 15, 2005 hearing to allow the
operator sufficient time to carry out the proposed plan. When the reclamation has been completed and
any increase to the bond has been posted, the Division will consider withdrawing the notice of possible
violation.
If you have any questions about this process or how the bond was calculated, please contact me at (303)
866-4943.
Si erely, ~~
Enca S.
