AVDW shareholders suffer an additional loss of available water within a drought <br />year, not just the individual shareholder. <br />Our primary concerns are based upon protecting the viability of the ditch company, and <br />seeing that all shareholders receive the water shares in which they are entitled. We <br />assume that the Dillon proposal includes additional water sources to sustain the proposed <br />gravel operation and 40 acre lake. <br />Our primary concern is the appropriate use of AVDW water. The Board of Directors <br />does not see gravel operations or water storage as beneficial use of AVDW water. The <br />AVD W would restrict use of any water shares not consistent with our history of water <br />usage. <br />Per state law and the planning process, the AVDW was notified of the Dillon Land Use <br />Proposal because of our ditch right-of--way through the affected property. Consistent <br />with prior land use changes and sub-divisions within the East Animas Valley, the ditch <br />company has obtained documented easement through the planning process. Similarly we <br />requests that a recorded easement of specific dimensions be incorporated within the <br />Dillon property upon project approval. (Currently we have a nonspecific easement based <br />solely upon historic need and usage). We feel establishing a determined easement is in <br />the best interest of landowners and the ditch company. We request a 50 foot set back <br />distance, 30 feet above and 20 feet downside from the ditch centerline. With the recent <br />and ongoing risk of fire related flooding in the area a documented easement becomes <br />increasingly important to ditch operations. <br />The Board of Directors feel it is their duty to protect the viability on the AVDW, and to <br />see that all shazeholders receive all waters to which they are entitled. We ask the La Plata <br />County Commissioners, when making their decision Monday, that the Dillon project has <br />available water other than that from the Animas Valley Ditch & Water Company. We <br />also ask your continued support in obtaining a documented easement along the AVDW <br />ditch right-of-right, to better serve and protect both shazeholders and landowners alike. <br />We have appreciated your past and continued assistance.
