P.E., Dir. of Transportation, Boulder County <br /> Paul Blisk, Assistant Zoning Administrator <br /> Graham Billingsley, Land Use Department Director <br /> SUBJECT: Flatiron Property - Status <br /> Based upon review of out files and discussions with staff members the following is a summary of the status of the <br /> South Boulder Creek floodplain and related issues for the Flatiron Companies gravel mine site(Deepe/rumpike Pits) <br /> located south of the U.S. Highway, 36 and South Boulder Road intersection: <br /> Backeround <br /> In 1979. Flatirons Co. requested permission from Boulder County to cominxt a dike and diversion A—A in the <br /> adopted floodplam of South Boulder Creek. The purpose of the dike and A-3 were stated to be for the protection <br /> of sand and gravel mining operations from inundation by flood waters(the proposal did not request removal of the <br /> property within the protected arcs from the adopted floodplain). It was determined that tender the requirements of <br /> Sections 19.5 and 24 of then current Boulder County Zoning Resolution (adopted November 20, 1979)that such <br /> a structure would be considered'accessory to open uses' requiring the issuance of a Special Permit.The application <br /> for the permit included a floodplain analysis by Leonard Rice Consulting Water Engineers which addressed the <br /> impacts an the floodplain from the proposed dike and diversion channel. <br /> On February 20, 1990, the Planning Commission of Boulder County adopted a resolution which approved the <br /> Special Permit with the following conditions: <br /> 1. Any smeadmeat to the County Zoning Resolution should not be considered until the new Corps <br /> of Engineers flood study for South Boulder Creek is available; <br /> 2. If the an protected by the dike is to be considered for removal from the floodplain in the future, <br /> the applicant would be responsible for modifying the proposed or constructed dike to meet the <br /> requirements following the Corps of Engineers study; <br /> 3.
