EASEMENT AGREEMENT BETWEEN <br />TEDDIE & TINA GRAFF <br />OLDCASTLE SW GROUP, INC. DBA UNTTED COMPANIES OF MESA COUNTY <br />This agreement between Teddie & Tina Graff and Oldcastle SW Group, Inc. dba United <br />Companies of Mesa County (United Companies) shall be for a mutually useable road <br />easement along the North property boundary line for a distance of/. mile not to exceed 50 <br />feet in width. <br />All expenses of bringing the easement to Delta County requirements shall be the <br />responsibility of United Companies. All costs of maintaining said easement shall be the <br />responsibility of United Companies. <br />For and in consideration of said casement, United Companies shall maintain the drain ditch <br />between [he Anderson (or United Companies) property and [hc Graff property to a depth of <br />six feet on the east end with all cleaning materials to go on the United Companies side. <br />Gratfs shall have the right to match bids on all outside work [o remove topsoil, mine gravel <br />and or reclaim pit. <br />Gmffs shall receive 51,000.00 credit for use of gravel or concrete per year for the duration of <br />the easement. <br />The road created in [his easement will cemain intact after reclamation of the Anderson Pit in <br />order to allow for farming access. This easement shall be a part of the permit boundary. <br />This agreement shall be good for the period of one year while United Companies permits and <br />works on the purchase agreement for the Anderson farm. After the one year period has <br />expired, this agreement is contingent upon United Companies having purchased the <br />Anderson farm.
