EXHIBIT "A" <br />PERMISSION TO ENTER MINE AND RECLAIM <br />I/we the undersigned Owner(s) of certain real estate located in Weld County, Colorado ("Property"), hereby grant L. G. <br />Everist, Inc. (hereinafter referred to as the "Applicant /Operator") permission to enter and initiate permitting, exploration, <br />mining, and reclamation activities on the Property described below and made part of the Colorado Division of Minerals and <br />Geology Regulaz 112 Mining and Reclamation Permit application described below. While the undersigned owner(s) give <br />permission to include the property in the application, this agreement shall not be construed as an express or implied contract <br />to sell or to lease the property. <br />The aforementioned Property is composed of the following two pazcels of legally described real estate and is comprised of <br />34.79 acres, more or less: <br />Weld Countv Parcel No. 130930000068: That part of Lot 6, which is located in the SW 1/4 of the NE 1/4 of Sec. <br />30, T2N, R66W, 6's PM, Weld County, Colorado, according to the Lupton Meadows Land Company Map of <br />Division No. 3, recorded June 12, 1909, lying west of the centerline of the South Platte River, said centerline <br />described as beginning on the S line of Lot 6 aY a distance of 610' E of [he SW comer of Lo[ 6 N33D54'E 190' <br />N59D29'E 470' NSOD29'E 262.1 T to E line of Lot 6, except that part of the N 1/2 of Sec. 30, T2N, R66W described <br />in Book 804, Reception No. 1726470 (2.50 acres, more or less) and Reception No. 1726471 (2.36 acres, more or <br />less); also except beginning 2.5' N and 4.5' E of the center point of said Sec. 3Q, thence N by NE on a straight line a <br />distance of 1325' more or less to a point 36.2' E of the NE comer ofthe S %z of the NW %. of said Sec. 30, thence W <br />36.2' to the said NE comer, thence S on the E section line of the S %z of the NW '/a of said Sec. 30 a distance of <br />1325' more or less, to a point on the said section line 2.5' N of the center point of said Section 30, thence E a <br />distance of 4.5' more or less to the point of true beginning, consisting of approximately 29.93 acres, more or less. <br />Weld Countv Parcel No. 130930000051: That part of Lot 6, which is located in the SW l/4 of the NE 1/4 of Sec. <br />30, T2N, R66W, 6"' PM, Weld County, Colorado, according to the Lupton Meadows Land Company Map of <br />Division No. 3, recorded June 12, 1909, which is described in Book 804, Reception No. 1726470 (2.50 acres, more <br />or less) and Reception No. 1726471 (2.36 acres, more or less) and described as gravel pits, consisting of <br />approximately 4.86 acres, more or less. <br />The aforementioned Regular 112 Mining and Reclamation Permit is for the following site: <br />Fort Lupton Sand and Gravel Mine, Per~n~t No. M-1999-120, and any su menu <br />~c6tw K• GxQr1, t`Mv#Ga/e SL.Qn+Gau?JV Rt[ <br />oBtN M.
