to the "baseline" water data for a determination of whether an adverse impact to surface and/or <br />groundwater has occurred. Thus faz, the water monitoring data provided includes results from a <br />water sample of the underground workings mine gool collected on January 31, 2006 (comment <br />#8 Cash Mine; Amendment No. 2, response to 2" adequacy review comments, February 21, <br />2006), and water sample results reported in Table 1 (Cash Mine -Comprehensive Water <br />Monitoring Plan, November 2, 2006). At this point, it is uncleaz to the Division as to how many <br />quarters of baseline data has been submitted, what is to be considered baseline data, and how the <br />baseline data will be distinguished from on-going monitoring data. Please respond. <br />5. As previously requested in the Division's Cash Mine -Amendment No. 2 "2nd Adec~yg~}+ <br />Review Comments" the groundwater monitoring plan will need to include provisions for <br />determination of the groundwater gradient within the Cash Mine and surrounding azea. (This <br />information is being requested in conformance with Rule 6.3.3(1)(1)) Please provide. <br />6. The Operator notes in Attachment 1 -Groundwater Modeling of the Water Monitoring Plan <br />that under Post-Closure conditions, the water level will increase until seepage emerges from the <br />#1 Level adit area consistent with historic "pre-law" conditions, and not emergent as a point <br />source discharge. Please note that the approved mine and reclamation plan specifies a "zero <br />dischazge facility" during mining as well as final reclamation. As previously stated in the <br />Division's Amendment No. 2 "2nd Adequacy Review Comments", the operator will be required <br />to obtain an NPDES Water Quality Dischazge Permit from the Water Quality Control Division, <br />Colorado Dept. of Health in the event of any dischazge from the Mount Royal Adit #1 at any <br />time during mining and/or final reclamation. However, if the operator has any written <br />correspondence from the Water Quality Control Division, Colorado Dept. of Health to the <br />contrary, please provide. <br />Non-Designated Mining Operation Certification <br />Attached are review comments from David Bird.
