Mann Marital <br />Trust ("Lessor") and LAFARGE WEST, INC., a Delaware corporation ("the Company"). <br />On or about December 21, 2005, Lessor and the Company entered into an <br />Agreement for Lease of Site (the "Lease") pertaining to the Premises located at the <br />general vicinity of 11610 Brighton Road, Henderson, State of Colorado, and as more <br />specitically described in Exhibit A to the Lease. <br />Paragraph 2. of the Lease refers to Exhibit C which identifies certain areas of the <br />leased property which are excepted out from those areas of the leased premises in which <br />the Lessor has reserved rights to continue to use and occupy the leased premises. <br />The Lessor and the Company desire to modify the area of the leased premises <br />originally set forth in Exhibit C to the Lease, and replace it with a new Exhibit C, <br />attached hereto as Exhibit C, titled "Reclamation Plan". <br />This Amendment, or the sigtature pages thereof, may be executed in counterparts, <br />all of which will have full farce and effect as an otigirtal, including admission into <br />evidence. Facsimile signtatures shall be effective to bind each of the parties hereto. <br />However, each such party hereby agrees to provide the other with original signatures on <br />this Amendment at fhe earliest reasonable time after facsimile signatures have been <br />transmitted. <br />LESSON ANA TIIE COMPANY confirm and ratify in all respects the terms and <br />conditions of the Lease, as amended by this Amendment to Lease.
