GAL ~-3.s
DEPARTMENT OF THE ARMY
CORPS OF ENGINEERS, OMAHA DISTRICT.
DENVER REGULATORY OFFICE, 9307 S. Wadsworth Boulevard
LITTLETON, COLORADO 80128-6901
September 27, 2006
Mr. Steven Brown
Lafarge West, Inc,
10170 Church Ranch Way
Westminster, CO 80021
RE: M&G Pit Wetlands Determination, Eastern Portion, Released from DMG Bond, 20.71 acres
Released 2005
Corps File No. 19988]019
Dear Mr. Brown
Reference is made to the above-mentioned portion of the M&G Pit located in the NE '/a of
Section 3, T2S, R67W, Adams County, Colorado. This 20.71 acre of the M&G Pit, which includes
isolated wetlands and open water is not waters of the U.S.
This 20.71 acre area has been reviewed by Mr. Terry McKee of my office during his September
18, 2006 site visit. This visit was in accordance with Section 404 of the Clean Water Act under which the
U.S. Army Corps of Engineers regulates the discharge of dredged and fill material, and any excavation
activity associated with a dredge and Sll project in waters of the United States.
Based on the information provided, a Department of the Army (DA) Permit will not be required
for work at the eastern 20.71 acre portion of the M&G Pit. Although a DA Permit will not be required for
work at the 20.71 acre, this does not eliminate the requirement that other applicable federal, state, and
local permits be obtained as needed.
If there are any questions call Mr. Terry McKee of my office at (303) 979-4120 and reference
Corps File No. 199881019.
Sincerely,
~ ~ ~~LY
. ; (/
~- Timothy T.
