Room 215 <br />Denver, CO 80203 / <br />~/ <br />Subject: Permit No. M-1978-116, SM-18 Mine <br />Technical Revision Request <br />Dear Mr. Mount: <br />Cotter Corporation is hereby applying for a Technical Revision to mine reclamation Permit No. <br />M-1978-116 (as mentioned in our phone conversation of July 12, 2004). This permit covers the <br />SM-18 Mine, used to produce ore from the U.S. Department of Department of Energy Lease <br />Block No. AT(OS-1)-ML-60.8-C-SM-18. In order to more effectively mine the reserves on the <br />south portion of the lease block, Cotter's application for a technical revision involves deleting <br />• undisturbed acreage permitted at the SM-18 portal azea and adding acreage elsewhere. <br />The area Cotter is requesting to be released totals 5.0 acres. When the original application for <br />Permit M-1978-116 was submitted, Cotter could anticipate the need for surface disturbance but <br />could not show the exact location of some of it on a map. This was particularly true of <br />ventilation hole sites. The location of vent holes could only be determined as development and <br />exploration progressed. Cotter's stated intent in the original application was to handle the exact <br />locations of the permitted acreage for vent holes by means of technical revisions. Only one of <br />the six permitted vent hole sites was actually constructed. <br />Some of the other acreage listed on the original Exhibit A for roads and surface facilities is also <br />not delineated on the original exhibit C mine plan map. Therefore, Cotter cannot show on the <br />the revised Exhibit C, the boundary of all of the 5.0 undisturbed areas that are being requested <br />for release. However, the revised Exhibit C does show the undisturbed azeas that were <br />delineated on the original Exhibit C (in SE'/o SE'/4 Section 21, SW'/a SW'/< Section 22, and NW %4 <br />SW'/< Section 27, T 48N, R.17W). Furthermore, the revised Exhibit C also shows the surveyed <br />boundary of the total area actually disturbed by mining at the portal site in S W %4 Section 22 and <br />the one constructed vent hole in NW'/< Section 27. The total acreage permitted originally in <br />Permit No. M-1978-116 is 14.9 acres. The surveyed boundazies of the actual disturbance <br />encompass a total of 8.71 acres, leaving a total of 6.19 acres undisturbed.
