Letter to Ken Kluksdahl
Third Party Monitoring Report #1
page 2
Monitor had several discussions that refined the scope of the report.
This and all of the previous delays led to changes in tha MOU and in
the contract.
Battle Mountain has voiced concern about the analysis :reported for
total cyanide in well MW-13. The analysis of monitorinc{ well MW-13
indicates that Total Cyanide is present at the level of 0.03 mg/L.
This is 0.01 mg/L above the detection limit of 0.02 mg/L, A split of
this sample, collected by BMRI and submitted at the same time to the
same laDOratory indicated detection at less Lhan 0.02 mgjL. The
practical quantitation limit for this parameter is indicated to be 0.10
mg/L. In other words, the level at which cyanide can be reliably
determined is approximately 5 times higher than the level at which it
car. be detected. the Division will not act on the basis of a report
such as this unless the PQL is exceeded.
Bi ,~i~i :,motes that because sample i:,~ttles from i,iyi, cya„ide px,~c~ss psi„i.~
ware mixed in transit with sample bottles from low cyanide process
points, there was a breach of protocol, and therefore the analysis
reported for MW-13 may represent contamination. The Division concurs
with this assumption; the third party monitor has taken steps during
subsequent sample shipments to assure that no cross-contamination will
occur in this fashion.
As a result of the Division's and Battle *".ountain's review c:f the firsr
report, changes have been made in the Memorandum of Understanding
between Battle Mountain and the Division. In addition, the contract
betweer. the third party monitor and Battle Mounta_a was r.:odified.
Likewise, changes have been made in tP.e samplina_ and analytical
protocol, TR-006.
The Division appreciates the cooperation of Battle Mountain and the
assistance of RCG/xagler-Bai11y in this effort. Tree also ~pFreciate the
patience of the community of San Luis, for whom this report has been
long delayed.
Please distribute the required copies of the report for public
examination.
Persons with questions or comments should address those to Harry Posey
at the Division of Minerals and Geology (303J866-3567).
