Dear Mr. Lewicki:
On March 19, 2002, the Division of Minerals and Geology (DMG) received exhibits for amendment
application to the Berry Pit. On March 20, 2002, the DMG received the completed originals and copies of
the application forms, original sign certification sheet, required proofs of notices to county commissioners
and the local soil conservation district, receipt from the County Clerk that a copy of the application was
placed at the Clerk and Recorder's office and the correct fee of $1938.00.
Since the Succession of Operator (SO) process has not been completed and the presently permitted
operator is still United Companies of Mesa County, Inc., the DMG cannot accept the application at the
present time. As we discussed on the telephone, the SO process must be completed first, then the
application process can proceed.
